Terms and Conditions of Sale

These general terms and conditions of sale define the terms and conditions for the sale of our showcase website creation services.

1. Preamble

These general terms and conditions of sale (hereinafter "GTC") apply to all services provided by WebNergy in connection with the creation of showcase websites.

These Terms and Conditions prevail over any other general or specific terms and conditions not expressly approved by WebNergy.

3. Services offered

WebNergy offers two subscription plans for the creation and maintenance of showcase websites:

Flash Subscription

  • Single-page website
  • 1 minor change per month
  • Email support within 2 business days
  • SSL certificate included
  • Accommodation included

Thunder Subscription

  • Multi-page website (maximum 10 pages)
  • 4 major changes per month
  • Priority support within 1 business day
  • SEO optimized
  • Multilingual translation (7 languages available)
  • Accommodation included

4. Rates and payment terms

Offers

  • Flash subscription: €50/month or €276/year (-10% if you commit to annual payment)
  • Thunder subscription: €47/month or €540/year (-10% if you sign up for annual payment)

Prices are quoted in euros, including all taxes. Invoicing is done monthly or annually, depending on the option chosen by the customer.

For annual payments, a 10% discount is applied to the monthly rate.

Payment is made by direct debit via our provider Stripe. After each debit, the customer will receive an invoice.

5. Order and acceptance

Any order for services implies unconditional acceptance of these Terms and Conditions of Sale and Terms and Conditions of Use. The order is only final after acceptance by WebNergy and receipt of the first payment.

WebNergy reserves the right to refuse any order for a legitimate reason.

6. Performance of services

The delivery times provided are for informational purposes only. WebNergy undertakes to meet the agreed deadlines as far as possible.

Delivery is deemed to have been made as soon as the website is online and a notification email is sent to the customer.

7. Customer obligations

The customer agrees to:

  • Provide all the elements necessary for the performance of the service
  • Respect the intellectual property rights of others
  • Do not use the site for illegal purposes.
  • Make payments within the agreed time frame
  • Notify WebNergy of any changes to your contact details

8. Intellectual Property

The client retains ownership of the content (text, images, logos) that they provide. WebNergy retains ownership of the source code and technical structure of the website.

The client grants WebNergy a license to use its content for the creation and maintenance of the website.

9. Termination

The subscription may be terminated at any time by either party, with 30 days' notice.

In the event of termination, the site will be deactivated at the end of the paid period. The customer may request the recovery of their content within 30 days.

10. Right of withdrawal

In accordance with Article L221-18 of the Consumer Code, the right of withdrawal cannot be exercised for services that have been fully performed before the end of the withdrawal period and whose performance began after the consumer's prior express agreement.

11. Warranties and liability

WebNergy guarantees that its services comply with the agreed specifications. WebNergy's liability is limited to the amount paid by the customer.

WebNergy cannot be held liable for indirect damages or loss of data.

12. Force majeure

WebNergy cannot be held liable for delays or failures due to circumstances of force majeure as defined by French case law.

13. Applicable law and jurisdiction

These Terms and Conditions are subject to French law. In the event of a dispute, the French courts shall have sole jurisdiction.

In the event of a dispute, an amicable solution will be sought before any legal action is taken. Failing this, the dispute will be brought before the competent courts.
